In America at least, a mail-order seller _who can not prove delivery_ to a
customer _IS_ responsible for getting merchandise to his or her customer
regardless of the shipping circumstances. Otherwise it is mail fraud.

In order for a seller to shed the responsibility of shipping, he or she must
explicitly _disclaim_ responsibility for lost shipments and the buyer must
agree to it in some manner. Otherwise, the seller _IS_ responsible for
getting merchandise sent to his or her customer and proving that delivery
was made to the recipient.

Well, I just watched the CBS at 75 special;  They had two opportunities to
showcase FK (Crimefighters and Sci-Fi) but didn't avail themselves.  I knew
the chance was slim to none that FK would show up, but I was hoping. . . .

Of course, I guess, by CBS standards, FK was a failed program considering
they only had it for a season.  I guess it was better to focus on "Wild,
Wild, West," "Lost In Space," and the classic "The Twilight Zone."

I am also disappointed in general with the way the FK DVD's have (or haven't)
been marketed.  Sure it was cool they got Sci Fi to do the marathon and
advertise during it, but for the most part FK fans are going to buy or not buy
based on financial reasons, are it would have made more sense to me to see them
advertise during reruns of Buffy on FX or Angel on TNT,  to generate new
interest in the series.  My local best buy, 1 week later, still has all 5 of its
copies of FK buried in a spot where no one will see them unless they are looking
for them.  Instead of putting them next to Angel or Buffy DVD sets,   Well
thats my opinion anyway.

Was doing a little research into Cadillacs so as to be prepared when I find
that model kit I want to customize to look like Nick's Caddy.  I found this
site on the history of Cadillacs:

The 1961 model year seems to have the least information.  Of course, there
were less than 150,000 Caddys produced in 1961. . . and to think FK had 3 of
them.

According to Nigel at several cons, the dialogue had to be looped when the
script required the vampires to talk with their fangs in. He described the way they
sounded on the original track as "Daffy Duck does a vampire!"

Actually, when I first got mine (They are custom acrylic) I was told to sing to
the radio in the car till you sound ok. (In the car no one can hear you
lisp....) Also if they are acrylic or some other type of hardish material, you
can take a nail file to the points and make them a bit blunt so you don't hurt
yourself. (I poked my tongue and scraped up my bottom lip for a while till I got
used to them. I know too little too late, sorry if I had known I would have told
ya.)

www.midianonline.com has a huge selection of custom fangs too. Just a thought.
I'm not sure if they are still updating the website though. They do everything
from lestat to lost boys to FK fangs. (I think they still do FK fangs...)

Also, all fang will keep you from closing your mouth all the way, especially if
they are done correctly, the back has to be thicker than the front since there
is a lot of stress on the backs where your lower teeth touch them. I've snapped
the backs off of fangs just by talking! I was trying to get the backs as thin
as possible, I got them pretty thin but then had them snap while simplely
talking or even just by putting them on or taking them off. The back will always
be the weakest point on the fangs. It is the only place I've ever snapped mine
(Course it's pretty easy for me to get replacements, I just make my own, these
are not the same quality as the link provided by Cloud or listed above. They use
dental polymer acrylic I believe, I just use simple fake acrylic nails and a
dremel)

I'm totally sympathetic to the sistuation and I think
it's massively unjust.  I would want to scream!  but
(not to turn this into a discussion of ethics) one
could argue that the distributor sent it, the
deliverer delivered it, and therefore can't be held
responsible.  though i concede that both did these
sloppily, the one ultimately responsible is the jerk
that stole it, but what can you do?

postoffice.  I am afraid someone will walk off with mine too.  Sometimes the guy

You can dispute the charge to your credit card company.

B&N sent it. But you didn't receive it, and unless I missed something, B&N has
no proof that you did.  You paid for something, you didn't receive, so you
shouldn't have to pay for it. If they don't want to send a new set of DVDs, this
time with signature confirmation or something, reject the charge with your bank.

B&N is ultimately responsible for you're not getting the package. If they want
to fight with the postal service, let them. But until you receive the package
and they can prove you received the package, the sender is responsible for it.
(I saw it on People's Court a couple of weeks ago.)

Do did I...

The difference was that the seller did NOT have proof that he mailed the
concert tickets. As an eBay seller, and B&N as a business, no doubt keeps their post
office receipt that proves mailing. The seller on People's Court had NO receipt
or anything like that.

Although I doubt B&N lists, "not responsible for items once it has left our
hands," I most certainly do in my eBay auctions... "I am NOT responsible once I
mail the item" is clearly listed.

However, this really is an issue for an attorney (if we have any on the list)
to address. We can debate until the sun rises and burns Screed's bare bum, but
I'm sure this is an issue which has been addressed in court before, and it could
even vary from state to state. <g>

To me, it'd make more sense that the post office is responsible as the carrier
is the one who left the item in an unsecured location... Ooooo... could you
imagine this being something LaCroix ordered.

Hmmm.... LaCroix was on-line, I wonder if he'd be eBaying? I'm sure he might be
amused as to what people will buy and as to what they will pay for it. I don't
think the money would matter so much to him as the amusement factor.

As for Screed, no doubt he WOULD eBay if he can read well enough to do it.

B&N offers you shipping options. If you choose a shipping option that does not
involve insurance, receipt confirmation, or tracking, it's your problem, not
theirs. Their responsibility ends when they give your order to your chosen
shipping agent.

If you can prove that they did not turn the package over to the Postal Service,
then you can argue with them. However, if not, you decided to take a riskier
shipping method and you lost.

TODAY'S TIP: If you have this option, do what I do---have packages shipped to
your workplace. That way you can be sure it's not left outside, and it'll be
placed in your mailslot or other designated place. All my stuff from amazon.com
and from ebay is shipped to my company, with no problems at all.

This was especially important when I shipped a pot of cactuses home during a
visit to Tucson in February. I didn't want those poor things shivering on my
frozen, subzero doorstep! <g>
