Xoom is mergin with NBC and by accident my account was swallowed

I lost anything I stored there

I have started to rebuild my site with crosswinds
so my ULR has changed from the old http://members.xoom.com/silvercat/FK.htm
to http://www.crosswinds.net/~darkscorpio/FKmain.htm

it is not much so far but I think I can rebuild it, given time

Yes, I noticed this last night. Their ad is even more annoying now..grrr!! I
really want my own domain, maybe this Christmas...maybe...

Did any of you other site owners at Xoom get any notification that NBCi
was gulping them down?

I think that really bites.  I'm lucky in that I have my site backed up
on my local drive, and I'm in the process of searching for a new
provider.

It was always semi-bad, but with the unlimited space it seemed worth
it.  I haven't even been able to get my site to come up in the last day,
so who knows ... arrrrgggghhhh ... I just know this is a master plan of
Gates ... where's a real life LaCroix when you need one ...

(Un)Progress Report on the Book Sony Doesn't Want You to Read...

Within days of receiving a threat-ridden "cease and desist" order from Sony
Entertainment, I signed and sent to them an agreement stating that the
FOREVER KNIGHT novel ON HOLY GROUND was officially out of print and would not
be reprinted. I further stated that as the book had been sold at cost, there
were no proceeds and Sony was thus in absolutely no way harmed by this
fully-acknowledged infringement of its copyrights on FK.

22 days have now passed since Sony received this agreement, and there has
been no further communication from them. This is apparently typical of
studios who have served c&d orders on fanzines. Having rather thoroughly
researched this recently (!), I find a number of editors who were so served
-- but not a single one who was ever taken to court. There *are* court cases
wherein Sony has sued far bigger game, particularly CD & movie pirates and
software companies, for millions. One of the biggest -- Sony vs. Connectix
Game Co. -- recently went to court with 9 counts of copyright infringement
lobbied against the game co.  Big surprise -- Sony lost the lawsuit. (I'll
try not to feel too sorry for them.)

In light of cases like the above, a number of zine editors served with c&ds
by studios have recently been cheeky enough to defy the order, go on
publishing and dare the studio to do its worst. Alas, I am not one of these.
I will honor the signed agreement and stop printing and selling ON HOLY
GROUND. If, however, there are no further threats from Sony, I will in all
probability one day post the entire novel on my web site
(http://members.aol.com/JeanB7) along with the rest of my
fully-acknowledged-to-be-copyright-infringing fan fiction.

A kind soul in another state has offered to anonymously give away a few extra
copies of the novel in her possession in return for a charity pledge. (See
http://members.aol.com/brabant1228/howto.htm)  So, through one means or
another, ON HOLY GROUND will still be out there for fans to enjoy.

Please cross your fingers that nothing more will be heard on this from the
"friendly folks" at Sony, who are obviously clueless to the fact that
fanzines are actually *beneficial* to their intellectual properties.
Fanzines, and this book in particular, also happen to qualify under the "Fair
Use Doctrine" proviso of the US Copyright Code, which specifies material used
for "non-profit, educational purposes" as allowable (and non-prosecutable)
infringement.

So, while I don't begrudge Sony the right to protect its copyrights, swatting
fanzines is decidedly overkill, and not the best way to engender good
customer relations, either. Will I ever again be inclined to purchase
*anything* with Sony's corporate logo glued to it? Well, as a sage Monty
Pythoner once put it, "On that day, Satan shall ice skate to work."

        You probably do not want to know my age at the time of the original
StarTrek.
        Suffice to say, I am not enough of a Trekkie to know history
that old  :-)
        I didn't realize that there had been a campaign for the original
series.  I was familiar with the decision to revive the series as Next
Generation.
