That is indeed the automatic penalty Rochefort would suffer if he spoke. Unless, of course, a court order were issued *and* the Catholic Church decided to abide by it. But, such a decision would presumably not be taken at the local level: it would have too many potential ramifications. I'm sure there would be a lot of buck passing--and, for the Catholic church, the buck stops in Rome. As far as the story of "For I Have Sinned" is concerned, Rochefort has to choose between suffering excommunication (if he talks) and suffering the pangs of conscience (if he doesn't and someone dies). But it is actually his choice to make, for all that--in the interrogation room--he avers that he has no choice. And, although Nick is pressing him, there is in the episode no overt, explicit pressure from anyone in authority on either side. So, in the episode, it's his choice alone. If there were a court order, the first penalty would still hold, but on the other side imprisonment for contempt of court would be added to his pangs of conscience. The obvious difference would be that the church and court systems would both be *actively* pressing him to abide by their laws and threatening sanctions. I'd completely forgotten about this. (It was *years* ago.) Mind you, if it's the case I recall (because there were actually *two* such instances of men getting court orders), by the time the court got around to hearing the case, she'd already nipped across the border to a clinic in the States. If I recall, they made their ruling *knowing* she'd had her abortion already, because they wanted to be sure that no further ex-boyfriends tried it on. But yes: by their usual standards, the Supreme Court heard this case with great speed. A couple of weeks, I think. That time frame would at least make it a practicable plot for a story. Whether it would make a good episode is another matter. It certainly wouldn't be as exciting as the climax of "For I Have Sinned". (Which is not irrelevant.) But yeah: the Supreme Court can get the lead out. If it so chooses.
