He always could tell (after all there is such a thing as free will)  but if
he did    there would be     consequences.  I doubt if he could  continue
being a priest.   So  as I said before   it's a no win situation for him.

If Fr. Rochefort chose to break the seal of confession, it would mean automatic
excommunication, so yes, he wouldn't be a priest anymore.

TPTB finally realized that Screed the Sexy Carouche has a huge cult following.

  Tired of the television rat race, Sony decided to let Screed loose on the
unexpecting rats

  A Sony executive bought 'Screed in Repose' on eBay and is hoping to create
enough interest to re-auction it at a profit

  Screed's the new CEO of Sony DVD (Vachon was the previous one and Screed,
tired of the slacking to get Season 3 out, ceased control)

Uhr, call me a Ratpacker but I obviously meant "Screed SEIZED control."

  Would anyone believe that Natalie arranged the release of Season 3 so that
everyone could see the wild sexy-hot chemistry between her and Screed?

  (I want to know if anyone is worried what having Season 3 is going to force
me to write? I won't be in play rehearsals for a month after the release thus my
evenings will be free to write... <wRPg>)

The scriptwriter makes it *quite* clear that Fr Rochefort is a decent
person--someone who is truly appalled by the situation he finds himself in.
He and Nick are the ones who raise the point that there is someone's life at
stake.  Oh, Rochefort is told firmly that it doesn't make any difference to
his religious duty (and Nick is squashed by Stonetree).  But he is
definitely worried about the killer's potential victims.  That, after all,
is why he tries to warn Magda.

Me either.

But, yeah:  if someone were to try to get a court to order Rochefort to tell
the police what he knows, I'm sure it wouldn't be left up to him to decide
which he should obey.  Ultimately, the decision would be made by his
superiors in the Catholic Church.
    Not that this could have happened in "For I Have Sinned", of course.
The decision to apply for a court order would not have been made by Nick, or
even Stonetree.  And Stonetree certainly made it clear that he wasn't going
to be passing the buck further up the chain of command.
    In practice, if someone did try to get a court order to force Rochefort
to identify the killer, I suspect the issue would have dragged out for a
long time.  If a court *did* issue the order--and, if I've read the Wigmore
Test right, then it probably eventually would--the decision would certainly
not be instantaneous.  Judges agonize over their ruling in any case in which
both sides invoke the Charter.
    Furthermore, if the court order were granted, I'm sure that the Catholic
Church would promptly appeal the ruling.  And the appeal would have to be
heard.  And, of course, if the Court of Appeal upheld the lower court, the
church would appeal again.  And that appeal would have to be heard.
(Etcetera.)  It would probably finish up in the Supreme Court.

And, as Debbie points out, during all the months that this would take, the
issues would be hashed out by the press.  Loudly.
    And the court of public opinion would say....  (Mmm, what would it say?
Viewers of "For I Have Sinned", you are the closest we have to the court of
public opinion:  what would *you* say?)

Even if the Supreme Court ultimately upheld the court order, the Catholic
Church might still decide that the matter in hand is not Caesar's business.
They would then order Fr Rochefort not to render unto Caesar (it not being a
thing that is Caesar's), but instead defy the court order and keep quiet.
    And then he would have to make a decision who he would defy:  the church
or the court.  Debbie called it a "no win situation"--and that was long
before it got to this point.

Meanwhile, the murders would undoubtedly continue.

I'm not at all surprised that the scriptwriter decided to go for the
stake-out at the church, and the dramatic near-burning scene.

I don't know if this would have necessarily dragged out. In cases of urgency,
Canadian courts can work quite quickly, and this looks like a definite
candidate. If it looks like Fr. Rochefort knows who the killer is, and is in a
position to prevent future deaths at the hands of this extremely nasty serial
killer (decapitation, disemboweling, crucifixion), then the courts could move
very quickly indeed, and this case is fully capable of breaking the old speed
record. A similar case, about a man trying to bar his girlfriend from having an
abortion, went quite quickly to the Supreme Court because time was of the
essence, and the Supreme Court made a space in its calendar so that their
ruling
would not be one of mere academic interest.

Worried? No, not a bit. Excited, perhaps.... any excuse to read some fun new
fics is a good excuse to me.

karen (excited that she can finally erase season 3 from the memory of her PVR
where it's been since Sci Fi was airing the show)
